NOTICE OF PUBLIC SALE PURSUANT TO 14 M.R.S. §6323

By virtue of a Judgment of Foreclosure and Sale dated March 17, 2023 and entered in the Maine District Court, District Five, Division of Waldo at Belfast, Civil Action, Docket No. BELDC-RE-2022-028, in an action brought by SEABOARD FEDERAL CREDIT UNION, Plaintiff, against PHILIP A. WARMAN, Defendant, for the foreclosure of a Mortgage Deed dated January 14, 2014 and recorded in the Waldo County Registry of Deeds in Book 3837 Page 148, the statutory ninety (90) day redemption period having elapsed without redemption, notice is hereby given that there will be sold at public sale at the offices of Seaboard Federal Credit Union, 177 Main Street, Bucksport, Maine (the sale may be conducted outside if the agency is closed for any reason and attendees at the sale may be asked to observe social distancing due to the COVID-19 restrictions) on August 10, 2023, at 1:00 P.M., all and singular the premises described in said mortgage deed and being situate at 65 Prospect Street in Searsport, Maine together with the 14x70 Single Wide Mobile Home, 2 Bedroom, 2 Bath, Serial No. & HUD No. to be determined, situate on the mortgaged premises. Said mobile home is permanently attached to and has become part of the real estate.

The property shall be sold to the highest bidder at the sale. The sum of Five Thousand Dollars ($5,000.00) will be required to be paid in cash or by certified check payable to Seaboard Federal Credit Union at the time and place of sale. The balance of the purchase price is to be paid within thirty (30) days following the sale. Failure to pay the balance due within thirty (30) days following the sale shall be deemed a forfeiture of the successful bidder’s deposit. Additional terms may be announced at the time of sale.

The above property is being sold “as is” and will be conveyed by Release Deed without any warranty as to the condition, size or location of the property or the state of title to the property. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The Purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney. In the event a representative of the mortgagee is not present at the time and place stated in this notice, no sale shall be deemed to have occurred and all rights to reschedule a subsequent sale are reserved.

The property will be sold subject to utility easements and rights of way of record and utility easements and rights of way that are visible on the face of the earth. The property will be sold subject to real estate taxes assessed by and due and payable to the Town of Searsport.
